Conditions of use of APSjobs

APSjobs is owned, managed and maintained by the Australian Public Service Commission (the Administrator(s)) on behalf of the Commonwealth of Australia (the Commonwealth).

APSjobs is a website designed to assist the recruitment of Australian Government employees and incorporates the Public Service Gazette.

Application

The terms and conditions in this document apply to all users. You can register for different parts of APSjobs, and additional terms and conditions which apply to such registration are identified separately. They are additional to the terms and conditions which apply generally (that is, those terms and conditions in Parts 1, 2, 4 and 8).

When you register on APSjobs you are entering into an agreement with the Commonwealth of Australia that you accept these terms and conditions.

Part 1 - General terms and conditions

If you use APSjobs you are agreeing to:

  • use APSjobs at your own risk.
  • only use the website and its information in a manner consistent with your recruitment activity or the recruitment of Australian Government employees generally.
  • use the information lawfully.
  • agree to the collection and use of certain system information for statistical purposes.
1.1 Terms and conditions of registration

If you register on APSjobs you are agreeing to:

  • accept and abide by the terms and conditions of this document
  • accept and abide by the additional terms and conditions which apply to any other part of APSjobs on which you register
  • not use APSjobs or any part of it other than in accordance with the relevant conditions of use
  • the use of your personal information as specified
  • keep any information posted by you on APSjobs up to date
  • provide accurate information
  • not knowingly or recklessly introduce a computer virus, trojan or similar program to APSjobs
  • not link APSjobs to any other website without the express consent of the Administrator
  • agree to the collection and use of certain system information for statistical purposes
1.2 Breach of conditions

The Administrator reserves the right to refuse you access to the website and to remove any material lodged by you if you:

  • breach any of the terms and conditions of any part of APSjobs
  • act in any way which the Administrator believes is inconsistent with the terms and conditions of any part of APSjobs
  • lodge information which the Administrator believes is offensive in any way
  • behave in any way that is contrary to law

Part 2 - Collection of personal information

Certain personal information may be collected if you register on APSjobs.

This information may include such things as:

  • Name
  • Date of birth
  • Contact details
  • Previous work history
  • Employment preferences
  • Qualifications
2.1 Use of personal information

Personal information provided will be used to help you access APSjobs services and information, and to assist recruitment and employment activities relating to APS vacancies and potential vacancies.

Personal information may also be used for reporting purposes by the Administrator.

Any such reports will not identify you.

Personal information may also be used to canvass feedback from you in order to assist the Administrator evaluate and improve APSjobs services.

By registering, you are consenting to the use of your personal information by the Administrator for those purposes.

2.2 Security of personal information

All personal information received through APSjobs is stored on secure servers that are maintained by the Administrator.

All employees, contractors and users of IT facilities who maintain the systems of the Administrator are required to protect the confidentiality of your personal information.

The Administrator does not accept any responsibility for unauthorised access of your personal information through any facet of the APSjobs website.

Part 3 - Collection of system information

When you look at this website (www.APSjobs.gov.au), our service provider makes a record of your visit.

The following system information may be collected:

  • IP (Internet Protocol) address of the machine which has accessed it.
  • Top-level domain name (eg. .com, .gov, .au, .uk etc)
  • IP Address of your server
  • Date and time of your visit to the site
  • Pages accessed
  • Previous website visited
  • Type of browser and operating system you have.

The information collected during each visit may be used for statistical purposes only, mainly for the purpose of producing reports in order to identify patterns of usage of APSjobs. This will assist us in improving the website.

Part 4 - General disclaimer

Whilst the Administrator will endeavour to ensure that APSjobs is available to you when required, it does not guarantee to provide continuous or uninterrupted access to APSjobs.

The Administrator also does not guarantee this website or information downloaded or received from it is free from computer viruses.

All information on APSjobs is provided to the Administrator by registered users of APSjobs. The accuracy of the information is dependent on the users and the Administrator is not liable for any errors.

Certain information may contain material that includes the views or recommendations of third parties. Such material does not necessarily reflect the views of the Administrator (or the Commonwealth) or indicate a commitment to a particular course of action by the Administrator (or the Commonwealth).

Links to other websites are inserted for convenience and do not constitute endorsement by the Administrator (or the Commonwealth) of material at those web sites or of any associated organisation.

Part 5 - Email alert additional terms and conditions

If you register for email alerts you are agreeing that:

  • the information provided to you by the email alert system is dependent upon the information you provide to APSjobs
  • the Administrator is in no way responsible or liable if you do not receive or are not sent an email alert about any particular vacancy

You are also consenting to information being emailed to you regarding employment vacancies, updates or promotional material relevant to APSjobs.

Part 6 – Ready Now additional terms and conditions

Ready Now allows specified former APS employees to upload details of their work history and employment preferences.

The information provided is used to create a database that can be accessed by Australian Government employers searching for suitable candidates for non-ongoing (temporary) employment.

6.1 Conditions for registration

To register on Ready Now you must:

  • be a former Australian Public Service employee and must have an AGS number
  • be an Australian Citizen, or resident, or have a right to work in Australia
  • be looking for work in the APS
6.2 Conditions of use

If you register on Ready Now you must:

  • ensure that information provided by you is accurate and up to date
  • remove your details if you are no longer looking for work in the APS
  • not provide material that is in any way offensive
6.3 Additional disclaimer

Neither the Administrator nor the Commonwealth:

  • guarantees the accuracy or reliability of any of the material placed on Ready Now
  • endorses any of the users that have lodged material on Ready Now
  • in any way warrants or certifies that any or all users are suitable to perform the duties of any temporary employment position
  • has performed any assessment as to the skills, attributes, qualities or suitability of any or all of the persons lodging material on Ready Now
6.4 Additional information on personal information

Information provided by you to Ready Now can be viewed by registered Agency Users.

Information might be disclosed by registered Agency Users in the course of recruitment activity to persons including your current employer or Agency, or another Australian Government Agency, or a person or body authorised by an Australian Government Agency to assist with or provide recruitment services.

By providing information to Ready Now you are consenting to that disclosure and use.

Part 7 – Branching Out additional terms and conditions

Branching Out allows current APS employees to upload details of their work history and employment preferences. The information provided is used to create a database that can be accessed by Australian Government employers searching for suitable candidates for ongoing movements at level or non-ongoing (temporary) employment opportunities.

7.1 Conditions for registration

To register on Branching Out you must:

  • be a current ongoing Australian Public Service employee and must have an AGS number.

Employees registering on Branching Out should make themselves aware of their obligations under the APS legislative framework in relation to movement between and within APS agencies, in particular Regulations 3.9 and 3.9A of the Public Service Commissioner’s Regulations 1999.

7.2 Conditions of use

If you register on Branching Out you must:

  • ensure that information provided by you is accurate and up to date.
  • remove your details if you are no longer looking for work in the APS.
  • not provide material that is in any way offensive.
7.3 Additional disclaimer

Neither the Administrator nor the Commonwealth:

  • guarantees the accuracy or reliability of any of the material placed on Branching Out
  • endorses any of the users that have lodged material on Branching Out
  • in any way warrants or certifies that any or all users are suitable to perform the duties of any position.
  • has performed any assessment as to the skills, attributes, qualities or suitability of any or all of the persons lodging material on Branching Out.
7.4 Additional information on personal information

Information provided by you to Branching Out can be viewed by registered Agency Users.

Information might be disclosed by registered Agency Users in the course of recruitment activity to persons including your current employer or Agency, or another Australian Government Agency, or a person or body authorised by an Australian Government Agency to assist with or provide recruitment services.

By providing information to Branching Out you are consenting to that disclosure and use.

Part 8 – Campaign Register additional terms and conditions

Campaigns advertised on APSjobs allow candidates to upload details of their work history and employment preferences. The information provided is used to create a database that can be accessed by Australian Government employers searching for suitable candidates for employment opportunities.

8.1 Conditions for registration

To register on a Campaign you must:

  • be looking for work in the APS
8.2 Conditions of use

If you register on a Campaign you must:

  • ensure that information provided by you is accurate and up to date
  • remove your details if you are no longer looking for work in the APS
  • not provide material that is in any way offensive
8.3 Additional disclaimer

Neither the Administrator nor the Commonwealth:

  • guarantees the accuracy or reliability of any of the material placed on Campaigns
  • endorses any of the users that have lodged material on Campaigns
  • in any way warrants or certifies that any or all users are suitable to perform the duties of any position
  • has performed an extensive assessment as to the skills, attributes, qualities or suitability of any or all of the persons lodging material on Campaigns
8.4 Additional information on personal information

Information provided by you to Campaigns can be viewed by registered Agency Users and Administrators. Information might be disclosed by registered Agency Users or Administrator in the course of recruitment activity to persons including your current employer or Agency, or another Australian Government Agency, or a person or body authorised by an Australian Government Agency to assist with or provide recruitment services.

By providing information to a Campaign you are consenting to that disclosure and use.

Part 9 – Career Transitions and Support Centre additional terms and conditions

The Career Transition and Support Centre Snapshot allows current APS employees, who have been referred to the Centre by their agency, to upload details of their work history and employment preferences to create a CV summary.

This information will be available to Australian Public Service Commission employees to assist in matching suitable candidates to vacancies available within the Australian Public Service.

9.1 Conditions for registration

To register a Snapshot you must:

  • be a current Australian Public Service employee who has been referred to the Career Transition and Support Centre by your agency.
9.2 Conditions of use

If you register a Snapshot you must:

  • ensure that information provided by you is accurate and up to date
  • contact your Case Manager or the Career Transition and Support Centre if you are no longer looking for work in the APS
  • not provide material that is in any way offensive.
9.3 Additional information on personal information

Information provided by you can be viewed by registered Case Managers and Administrators. Information might be disclosed by your Case Manager to Australian Government employers in the course of recruitment activity to persons including your current employer or Agency, or another Australian Government Agency, or a person or body authorised by an Australian Government Agency to assist with or provide recruitment services.

By providing information in your Snapshot you are consenting to that disclosure and use.

Part 10 – Agency User additional terms and conditions

Registered Agency Users can access and use information on Ready Now, Branching Out, the Career Transition and Support Centre Register (CTSC Register) and Campaigns to assist with recruitment activities. Registered Agency users can also place information on the Branching Out and Campaigns pages, and in the Public Service Gazette.

10.1 Conditions for registration

To register as an Agency User you must:

  • be authorised by an Australian Government Agency to be an Agency User
  • provide a copy of that authorisation to the Administrator or Agency User Administrator
10.2 Conditions of use

If you register as an Agency User you must:

  • only use information obtained from APSjobs to assist in recruitment related activities in your Agency
  • treat all information as staff-in-confidence
  • only use information obtained from the CTSC register for redeployment activities
  • ensure that any information provided relating to vacancies adequately and fairly describes the vacancy and the required skills and attributes
  • not provide information that is misleading or offensive
  • only submit material for inclusion on APSjobs that complies with the requirements of the APS legislative framework (if it relates to an APS agency)

In addition, you must ensure that all recruitment and selection processes required by the APS legislative framework are complied with.

10.3 Additional disclaimer

Neither the Administrator nor the Commonwealth:

  • guarantees the accuracy of any of the material placed on Ready Now, Branching Out, CTSC Register or Campaigns
  • endorses any of the users that have lodged material on Ready Now, Branching Out or Campaigns
  • in any way warrants or certifies that any or all users are suitable to perform the duties of any position.
  • has performed any assessment as to the skills, attributes, qualities or suitability of any or all of the persons lodging material on Ready Now or Branching Out
  • has performed any extensive assessment as to the skills, attributes, qualities or suitability of any or all of the persons lodging material on Campaigns or CTSC Register
  • warrants or certifies that by using information on this website Agency Users will have complied with their recruitment obligations under the APS legislative framework

Part 11 – Other Matters

11.1 Commonwealth Copyright

Material displayed on APSjobs is subject to copyright. No unauthorised use is permitted.

11.2 Offence

The Criminal Code Act 1995 states that it is an offence if you give information to the Commonwealth if you are aware the information is false, or you leave out information so that information you do give is misleading.

Under these circumstances giving false or misleading information is a serious offence and appropriate action may be taken against you.

11.3 Security

While the Administrator endeavours to provide a secure internet environment, users should note there are inherent risks associated with transmission of information via the internet. Users should make their own assessment of the potential risks to the security of their information.

11.4 Compliance with laws

It is your responsibility to ensure that any actions taken by you in using APSjobs complies with Commonwealth, State and Territory law.

If the Administrator considers that any information is in breach of any law it will immediately remove the information that has been posted.

11.5 Indemnity

You agree not to hold the Administrator, its officers, employees, agents or subcontractors liable in any way for any loss or expense (including legal expenses) resulting from any claim or action resulting from any wilful, unlawful or negligent act or omission by the Administrator or the Administrator’s officers, employees, agents or subcontractors in connection with APSjobs.

11.6 Change and amendment

The Administrator reserves the right to remove, delete or change the location of any information contained within the website at any time.
